BCC 592/2015

This case involved unpaid fees to a professional expert who had been appointed by the Judicial Guardian to work on the allocation of an inheritance. Key issues included the court jurisdiction, time limit for the claim and an agreement for specific fees.

Background

Some claimants filed a claim before the High Civil Court requesting the court issue an order against the defendants to pay them 24000 Dinars because they were appointed as a panel to oversee the allocation process for an inheritance and they agreed on their fees with the judicial guardian appointed for this inheritance. However they had done the work but were not paid.

The court said it did not have jurisdiction to consider the case and referred it to the competent minor court. The minor court said it could not be considered because it had been filed after the deadline under Article 367 of Bahrain Decree-Law No. 19/2001.

The claimants appealed the ruling before the high court of appeal which issued a ruling repealing the appealed ruling and estimating the fees of the claimants as 5000 Dinars.
