BCC 496/2015

This case involved a request to annul a ruling and nullify a property sales contract as it had been found a contract was forged. For a ruling to be nullified it had to be appealed in the correct way.

Background

A claimant filed a case with the civil court against the defendants and another person who was not litigated against in this case. He requested to annul the ruling issued in the case 8563/2006 from the Civil Court and his appeal No. 1317 of 2012 and to consider it as if it and its legal consequences did not exist.

They said that the defendants had previously filed a case against them nullifying the sales contract and registering a real estate property in the name of the seller.

Decision

The court dismissed the case.

The claimant appealed the ruling before the Court of Appeal, which upheld the ruling.
