The initial dispute involved a request to liquidate a partnership and return money because the purpose which had been to buy franchises was no longer possible. The court had ruled it lacked jurisdiction because this was an international commercial dispute over a specific amount. Therefore it had not ruled on the existence of the partnership so an appeal on this point was not possible.

Background

A claimant filed a case with the High Civil Court requesting the defendant to pay him 252,000 Dinars plus interest because the defendant had asked him to enter into a partnership with him in order to buy an exclusive franchise to an American restaurants chain in six Arabic countries and the claimant had transferred 2 million USD as the price for his share but later the claimant found out that the agent of the American company had sold the franchise rights to others and he did not pay his share to the company and as such he wanted to revoke the agreement and get back his money.

The court said it did not have jurisdiction to consider the case.
