BCC 423/2015
This case involved a tenancy which had ended. The landlord requested compensation as the tenant had not vacated the property on time. The tenant filed an urgent case for compensation for equipment and furniture which had been confiscated by the landlord. The court had been wrong to ignore the tenant's request.
Background
A tenant filed a case with the Civil High Court requesting the landlord to pay 27,000 Dinars and interest because the tenant had rented a shop to operate a business for two years. The two parties then agreed to reduce the rent and then to end the tenancy relationship but due to a dispute between them the tenant filed an urgent claim for equipment and furniture which had been confiscated by the landlord which was worth the requested amount.
The landlord filed a case with the same court requesting the tenant to pay 4,000 Dinars because the tenant had not vacated the property in time.
The court of first instance dismissed the case of the tenant and in the case submitted by the landlord the court requested the tenant to pay the landlord 3200 Dinars.
