This case involved an employee's dues on dismissal. A key issue was the calculation of holiday pay on termination.

Background

An employee brought a claim against the employer before the labour cases department requesting his labour dues and compensation because he had been working for three years for an employer but he was dismissed without notice and without a reason.

The case was referred to the high civil court which requested the employer to pay the employee a certain amount of money for his annual leave, provide an end of service certificate, and interest but refused the rest of the requests.

The employee appealed the ruling before the court of cassation claiming that it had erred in the application of law and contradicted the same because he was given less than he was due.
