This case involved whether two managers were liable to pay damages under tort when their company had failed to carry out an agreed service. A key point was that the service agreed was not covered by the company's license.
Background
A claimant filed a case against a company and its two managers before the court requesting them to pay 15172.105 Dinars and legal interest. The claimant said that he agreed with the company on decoration work for his shop and he paid 29000 Dinars but they failed to finish the work.
The court ruled that the company should pay the claimant 14402.105 Dinars.
The claimant appealed the ruling before the court of appeal. The court said that the claimant had no right to appeal the ruling against the company and dismissed the appeal against the two managers.
