This case involved a claim by an employee for unfair dismissal, although the place where he worked had been closed. Under these circumstances the employee was still entitled to half his compensation and this had not been received.
Background
An employee made a complaint against a company before the Ministry of Labour claiming she was dismissed from her job without justification. The employee requested the company pay her due entitlements and compensation. The Ministry referred the case to the court.
The court dismissed the case.
Decision
The employee appealed the ruling before the court of cassation and said in her grounds of appeal that the ruling had erred in the application of law and had insufficient evidence of causation. It was said that the court had dismissed the request for compensation based on the argument that the conditions stipulated by Article 110 of the Labour Law existed in the case though this was not the case.
