Background

An employee filed a case against an employer before the court. She requested the court to order the employer to pay her compensation. She said that the employer had dismissed her from her job without legal justification.

The court ruled that the employer should pay the employee 450 Dinars.

The employee appealed the ruling before the court of cassation. She said in her grounds of appeal that the appealed ruling had violated the law. She said that the court had established its ruling on the grounds that the employment contract was indefinite one although her employment contract was a two-year contract.

The court said that this argument was valid. The court said that Article No. 111 of Bahrain Law No. 36/2012 stipulated that the employer should pay the employee compensation if they terminated the employment contract before its end. The court said that the documents of the case revealed that the employee was working under a two-year employment contract.

The court repealed the ruling.
