This case involved unpaid rents and eviction of a commercial property. A key issue was whether it was possible to make an appeal to the Court of Cassation in such cases.
Background
A landlord filed a claim against a tenant company before the committee for tenancy disputes requesting the company to pay him 27600 Dinars in outstanding rent. The landlord also requested that the company vacate the rented offices. The landlord amended the amount later by reducing it to 143500 Dinars because the company had paid some of the outstanding rent. The committee appointed an expert and the landlord submitted a statement requesting to amend his requests stating he requested the company to pay 22550 Dinars and vacate the properties. The tenant deposited 8200 Dinars with the court. The committee accepted the requests of the landlord by cancelling the contract and requested the tenantpay him 14500 Dinars plus interest. The tenant appealed before the High Civil Court which upheld the ruling. The company appealed the ruling before the court of cassation.
