BCC 187/2015

This case involved a severance pay case. A key issue was whether there was evidence that the statute of limitations applied and what was their last day's work.

Background

An employee filed a case against an employer before the court. He requested the court to order the employer to pay him 50000 Dinars in severance pay.

The court dismissed the case due to the statute of limitations.

The employee appealed the ruling before the court of cassation. He said in his grounds of appeal that the appealed ruling had violated the law. He said that the court established its ruling on the grounds of the testimonies of witnesses though he provided the court with the documents that proved that his last day in work was on 28/02/2013, namely before the period of limitation stipulated by Article No. 136 of Bahrain Law No. 36/2012.

Decision

The court said that this argument was valid. The court said that the documents of the case revealed that the employee had maintained before the court that he had finished his work before the end of the limitation period but the court dismissed this defence.

The court repealed the ruling.
