BCC 1113/2015

This case involved the unfair dismissal of an employee. The employer claimed they had dismissed the employee due to unjustified absence. The court had failed to refer the case to investigation.

Background

An employee filed a case against a company before the court. He requested the court to order the company to pay him compensation. He said that the company had unfairly dismissed him from his job.

The court ruled that the company should pay the employee 14300 Dinars.

The company appealed the ruling before the court of appeal. The court dismissed the appeal and upheld the appealed ruling.

The company appealed the ruling before the court of cassation. The company said that the appealed ruling had erred in the application of law and had violated the right of defence. The company said that they had maintained before the court that the employee was dismissed due to his absence for ten days without notice though he had received a written warning. The company said that they had the right to dismiss the employee in accordance with Article 113 of Bahrain Law No. 23/1976.
