Appeal – Contract – Litigation Procedures – Remedies - Interest
The initial dispute involved a claim for an amount plus interest which had not been paid under a contract. The key issue was whether the court of appeal could reject an appeal because the parties had not attended it if one of the parties had not been notified of the trial date.
Background
A claimant brought a claim against the defendant before the Court of First Instance. The claimant asked the court to require the defendant to pay them a sum of money and interest. The claimant stated that it had a contractual agreement between with the defendant and had performed all their obligations under the contract but the defendant had failed to pay all the money due under the contract.
