This case involved whether a property contract should be cancelled as the real purchaser had asked his brother to act as the buyer of the property and transfer it to him once he had Bahraini nationality.
Background
An actual buyer filed a case against an ostensible buyer and seller before the court claiming his brother bought the land through a customary contract and he paid for it. The actual buyer said that the land was registered under the name of his brother (ostensible buyer). The actual buyer said that his brother had failed to transfer the ownership of the land to the actual buyer.
The court dismissed the case.
The actual buyer appealed the ruling before the court of appeal. The court dismissed the appeal and upheld the appealed ruling.
