The original dispute involved the payment of the amount of a cheque which had been paid during a property purchase. One of the parties had decided not to go through with the sale and the question was whether the other party had the right to the cheque amount. The cheque was classed as a retainer.
Background
A person filed a case against another person and requested the court force them to pay him 30,000 Dinars with interest in exchange for a cheque which the second person had signed. The second person stated there was no reason for them to pay the cheque as they had stopped the purchase of the building it related to from the first person. The court ruled the second person should pay the cheque amount. The second person appealed the ruling before the court of appeal. The court rejected the case.
