This dispute involved land which had been inherited but for which ownership had been transferred by an order to another party. It was wrong to argue this transfer was not valid as the order had been before the death of the original owner as this had not been raised in the lower courts. The case also provided guidance on the notification of the change of ownership.
Background
An appellant brought a claim against an appellee asking for an order to repeal the right of ownership and possession over two pieces of land. The appellant argued that he had inherited these two pieces of lands and on a visit he seen buildings on the land which belonged to the appellee. The appellant had received a letter from the appellee informing him of their right to own the lands under Order No 440.
