Background
A claimant filed a case against a defendant before the court requesting the dismissal of the acquisition decision issued by the defendant. The claimant said that their land was acquired in order to extend the area around a royal palace. The claimant said that they were damaged as a result of the decision.
The court dismissed the case.
The claimant appealed the ruling before the court of appeal. The court upheld the appealed ruling.
Decision
The claimant appealed the ruling before the court of cassation and said in their grounds of appeal that the ruling had violated the right in defence and that they maintained before the court that they wanted to exploit the land for a touristic project and that the acquisition of the land did not achieve public interest but the court dismissed this defence.
