Background

A company filed a case against a defendant before the court requesting the defendant pay 27495 Dinars and interest. The company said that it printed a weekly newspaper issued by the defendant's company and they still owed the mentioned amount.

The court ruled that the company should pay the company the amount.

The defendant appealed the ruling before the court of appeal. The court upheld the appealed ruling.

Decision

The legal representative of the company appealed the ruling before the court of cassation and said in his grounds of appeal that the ruling had erred in the application of law because the court had established its ruling based on the argument that case was filed against the company and that the court ordered the company to pay the amount and that he made the appeal in person though he made the appeal as a partner under Article 13 of the company's contract.
