This case involved the sale of a car where a previous ruling had ruled the money for the car should be returned. The key question was whether as the car had been used for a long time before this happened money should be paid for its use and maintenance.
Background
A claimant filed a case against a defendant and requested the court to order the defendant to pay him 18400 Dinars. The claimant stated the defendant had bought a car from him and a previous ruling was issued against him to pay back the money for the car. The claimant stated that he deserved money for the maintenance of the car and an amount of money in exchange for benefitting from the car.
The court ruled the defendant should pay the claimant 1974.370 Dinars as compensation for using the car.
The claimant appealed the ruling before the court of appeal. The court upheld the appealed ruling.
