Employment – Termination of Employment – Resignation – Compensation – Unpaid Wages
This case involved a request for compensation by an employee who had been forced to leave his job as his wages had not been paid. This was correct as the employer had forced the employee to leave his position.
Background
An employee made a request to the Ministry of Labour and stated he worked for the defendant but he had left his job because they had refused to pay his wages. The employee requested the ministry to order the defendant to pay their wages. The disputed was then referred to the court.
The defendant filed a case against the employee and requested the court order the employee to pay 500 Dinars. The defendant stated the employee had received this amount to buy spare parts but he had spent it elsewhere.
The court ruled the defendant should pay the employee the late wages and ruled the employee should pay the defendant 500 Dinars.
The employee appealed the ruling before the court of appeal. The court upheld the appealed ruling.
