This case involved a request to appear a compensation level set by an evaluation committee for the loss of ownership of land. It was wrongly argued the time limit for an appeal should not apply when the owner had not been informed of the decision.
Background
A claimant filed a case against a defendant and requested the court to order the defendant to pay an amount of money as compensation for owning part of his real estate. The claimant stated the evaluation committee had informed him that the price per square metre would be 53.820 Dinars and he had objected to this estimate. The claimant stated the committee had rejected his objection.
The court stated the claimant had no right to file the case.
The claimant appealed the ruling before the court of appeal. The court upheld the appealed ruling.
