This case involved compensation claimed by passengers as a result of a flight delay. Most of the passengers had failed to prove the damage they had suffered as a result of the delay. The only person to be compensated for a minor who had missed an examination as a result.
Background
The claimants filed a case against a company and requested the court to order the company to pay compensation for a flight delay.
The court ruled that the company should pay the claimants 5100 Dinars and interest.
The claimants and the defendants appealed the ruling before the court of appeal. The court rejected the appeal made by the claimants and ruled the company should pay the claimants 2050 Dinars.
Decision
The claimants and the company appealed the ruling before the court of cassation.
In Appeal No. 209/2009: The company stated the ruling had violated the law because the claimants had failed to prove the damage which had resulted from the flight delay.
