BCC 147/641

This case involved whether a tenant who had agreed to leave a property in eight months should be evicted at the end of that period.

Background

The claimant brought an action before the Court of First Instance to evict a defendant from a villa he had rented. There was a contract between the parties. The defendant had agreed to leave in eight months but he had not left

Decision

The court refused to hear the case. The appellee appealed against the ruling. The court then ruled in favour of the claimant. The defendant appealed once again by Cassation. The Court dismissed the appeal and the defendant should be evicted.
