Background

A claimant filed a case against two defendants requesting that the court order them to pay an amount of money plus interest. The claimant stated that a fire affecting the headquarters of the first defendant had spread and damaged his shops.

The court rejected the case against the second defendant and ruled that the first defendant pay an amount to the claimant.

The claimant and the first defendant appealed and the appeal court ruled that the two defendants pay an amount.

Decision

Before the cassation court, the first defendant argued that the ruling had violated the law as she had maintained before the court that the case should be rejected for being filed against an irrelevant party as the claimant was responsible for maintaining the shops.
