This case involved a claim by an employee who had resigned for end of service gratuity. The employer had divided the service into periods and paid part of the end of service gratuity at the end of each of these periods rather than at the end of their final service, this was allowed.
Background
An employee made a complaint against a company before the Ministry of Labour claiming that he had resigned from his job but did not get paid his entitlements. The Ministry referred the case to the court.
The court ruled that the company should pay the employee the value of the entitlements.
The company appealed the ruling before the court of appeal. The court upheld the appealed ruling.
