Guarantee – Loan – Litigation Procedure – Case Reason
This case involved a claim by a loan guarantor who had had to pay a debt the amount paid. The key issue was whether the claimant was allowed to change the case reason if he maintained the same main point that he was owed this money.
Background
A claimant requested a judge to order a defendant to pay him 8000 Dinars. The claimant said that the defendant owed him the amount. The judge refused to issue a payment order and the case was referred to the court.
The court ruled that the defendant should pay the claimant the amount.
The defendant appealed the ruling before the court of appeal. The court dismissed the appealed ruling and dismissed the case.
