Background
An employee made a complaint against a company before the Ministry of Labour claiming that he was unfairly dismissed. The Ministry referred the case to the court.
The court ruled that the company should pay the employee 3200 Dinars as compensation and 73.6 Dinars for holiday pay.
The company appealed the ruling before the court of appeal. The court upheld the appealed ruling.
Decision
The company appealed the ruling before the court of cassation and said in its grounds of appeal that the ruling had violated the right of defence and that it had maintained before the court that it did not dismiss the employee from his job and that he willingly left the company. The company said that it had said the employee could return to his job but he refused the offer and did not deserve compensation.
