This case involved a claim for unfair dismissal by an employee. The company argued it was able to extend the probation period. This was not the case as there was no such term in the employment contract.
Background
An employee made a complaint against a company before the Ministry of Labour claiming that he was working for the company and that he was unfairly dismissed. The employee requested the company to pay him compensation and pay in lieu of notice. The Ministry referred the case to the court.
The court ruled that the company should pay the employee 9000 Dinars in compensation and 1500 Dinars for pay in lieu of notice.
The employee and the company appealed the ruling before the court of appeal. The court amended the appealed ruling and ruled that the company should pay the employee 4500 Dinars for pay in lieu of notice.
