This case involved a claim by an individual they had been unfairly deprived of a position as a deputy prosecutor and the Ministry of Justice had not followed the conditions in the job advertisement. This was irrelevant as the individual had come 17th in the exams and there was only 15 positions.
Background
A claimant filed a case against the Minister of Justice before the court requesting the dismissal of decision No. 26/2006. The claimant said the decision deprived him from being appointed as a deputy prosecutor although he met all requirements.
The court ruled that the mentioned decision should be dismissed.
The Minister appealed the ruling before the court of appeal. The court dismissed the appealed ruling and dismissed the case.
Decision
The claimant appealed the ruling before the court of cassation and said in his grounds of appeal that the ruling had insufficient evidence of causation and said that the Ministry of Justice had not complied with the conditions in the job advertisement.
