Evidence – Expert Report – Construction – Contract – Remedy – Urgent case
This case involved whether an expert report could be used in an urgent case involving amounts owed by a construction contractor. The mistake in the report should not have prevented it being used as evidence.
Background
An owner of a building filed a case against a contractor before the civil court requesting the contractor pay him 7057 Dinars and interest. The owner said that the contractor had agreed to build a home for him and he received the contract amount but he failed to commit to his obligations.
The court ruled that the contractor should pay the owner 389 Dinars and interest.
The owner appealed the ruling before the court of appeal. The court amended the appealed ruling and ruled the contractor should pay the owner 5089 Dinars.
