Evidence – Witness – Landlord – Tenant – Early termination
This case involved whether a tenant was required to pay rent for early termination of a tenancy. A witness stated the landlord had asked the tenant to leave and as there was no evidence of a judicial dispute between the landlord and the witness the ruling was based on this evidence.
Background
A landlord filed a case against a tenant before the court requesting the tenant pay him 575 Dinars and interest. The landlord said that the tenant had rented a flat from him for a monthly rent of 75 Dinars. The landlord said that the tenant left the property before the termination of the contract and failed to pay the remaining amount in the tenancy agreement.
The court ruled that the tenant should pay the landlord 525 Dinars.
The tenant appealed the ruling before the court of appeal. The court dismissed the appealed ruling and dismissed the case.
