Litigation Procedure – Ministry of Labour – Termination of Employment –Employee’s Rights – Unfair Dismissal
This case involved an employee's claim for compensation because of unfair dismissal. The employee filed a case with the courts which was rejected, then another on the same matter which was also rejected because they had not made a complaint to the Ministry of Labour. A complaint had been made to the Ministry but they had failed to file the case within the required timeframe so the employee had the right to file a case directly with the courts.
Background
An employee made a complaint against an employer before the Ministry of Labour claiming that he was working for the employer and was unfairly dismissed from his job. The employee requested the employer to pay his entitlements and compensation. The Ministry referred the case to the court.
The court deleted the case.
The employee filed another case with the same requests.
The court dismissed the case.
The employee appealed the ruling before the court of appeal. The court upheld the appealed ruling.
