Court – Jurisdiction – Employment Court – Commercial Concession – Employee’s Dues
This case involved an outstanding amount owed as part of a sale of a commercial concession. The key issue was whether the dispute fell under the jurisdiction of the employment court as it was argued the amount had not been paid as the original concession owner was liable for their employees' dues before the sale.
Background
A claimant filed a case against a company before the court requesting the company pay 16366 Dinars and legal interest for the remaining value of a commercial concession for some restaurants that he had sold to the company.
The company argued that the amount constituted the entitlements of the workers in the restaurants for the period before the signature of the sales contract and the claimant should pay it.
The court dismissed the case.
The claimant appealed the ruling before the court of appeal. The court dismissed the appealed ruling and said that the civil court had no mandate to consider the case and that the case should be considered by the labour court.
