BCC 329/2008
Background
An employee filed a case against an employer before the court claiming that the employer had recruited him from abroad to work as carpenter but then failed to offer him a job. The employee requested the employer to pay him compensation for damage and 1000 Dinars for a visa.
The court ruled that the employer should pay the employee 200 Dinars.
The employee appealed the ruling before the court of appeal. The court upheld the appealed ruling.
Decision
The employee appealed the ruling before the court of cassation and said in his grounds of appeal that the ruling had violated the law and said that the compensation that the court ordered the employer to pay did not fit with the damage. The employee said also that the court had not ordered the employer to pay for the visa though they failed to take the oath.
