This case involved a claim by a woman for compensation after a contractor had been late in completing the construction of a building and a counter claim by the contractor for additional worked he had been asked to do. A key issue was whether the expert had followed the correct procedures. The court had the right to rule based on the evidence.
Background
A woman filed a case before the Civil High Court against a contractor requesting he pay her 31570 Dinars as she had instructed him to build a building but he did not complete the building on time. The contractor filed an opposite claim requesting the woman pay him 36795 Dinars for additional work he had done in the building as per her request plus interest. The court unified both claims into one and appointed an expert. The court issued a ruling requesting the contractor pay the requested amount and dismissed his claim.
The contractor appealed the ruling before the court of appeal which issued a ruling upholding the ruling.
