Lawyer’s Costs – Interest
This case involved amounts owed by a client to a lawyer. The client had dismissed the lawyer during the litigation so they were not due the full amount. They did not owe interest for the delay in payment.
Background
A lawyer filed a case against a defendant before the court requesting he pay 2300 Dinars. The lawyer said that he defended the defendant's case before the court that he owed him the amount.
The court dismissed the case.
The lawyer appealed the ruling before the court of appeal. The court upheld the appealed ruling.
Decision
The lawyer appealed the ruling before the court of cassation and said in his grounds of appeal that the ruling had insufficient evidence of causation and that the defendant admitted that he was obliged to pay the amount to the lawyer. The lawyer said that the court had refused to order the defendant to pay interest based on the argument that the debt was not commercial.
