This case involved a claim by two employees who had been unfairly dismissed for their dues. A key issue was the workers' request for compensation for the injury was in fact compensation for the damages caused by the termination of the contract and the benefit ordered by the ruling was compensation for the delay in payment of an amount of money.

Background

Two workers filed a complaint before the Labour Ministry stating that they had been dismissed from work without justification. They requested compensation for unpaid wages and compensation for the damage, holiday pay, an end of service indemnity and a return ticket with their passports.

The case was referred to the Lower Court which ruled that the employer should pay each of the plaintiffs an amount for late payment of wages, dismissal compensation, an end of service gratuity and two return tickets with interest but refused other requests.

The defendant filed an appeal before the Appeal Court which confirmed the First Instance Ruling.
