Appeal – Litigation Procedure – Road Traffic Accident – Personal Injury – Insurance – Compensation – Power of Attorney - Lawyer
The initial dispute involved a claim against an insurance company for injury to two boys in a road traffic accident. The key issues included whether a power of attorney could be rejected for the appeal when a power of attorney had been accepted for the same lawyer at the court of first instance and the independence of two appeals.
Background
The claimants filed a case against an insurance company before the court requesting the company to pay them 22500 Dinars in compensation for damage which had resulted from a car accident in which their sons were injured. The claimants said that the car was insured by the company.
The court ruled that the insurance company should pay the estimated compensation.
The claimants and the insurance company appealed the ruling before the court of appeal. The court dismissed the two appeals and upheld the appealed ruling.
Decision
The insurance company and the claimants appealed the ruling before the court of cassation.
