This case involved money owed as part of an agreement to broker a deal between an insurance company and a bank. The court was wrong to award an amount based on an expert report without fully reviewing the contractual relationship between the parties and that there had been an earlier agreement between these two parties.
Background
A claimant filed a case against an insurance company before the court requesting the company pay him 160000 Dinars and interest. The claimant said that the company had assigned him as a broker to make a deal with a bank in exchange for 20% of insurance income. The claimant said that the insurance company agreed and signed a contract with the bank but it failed to commit to their obligations.
The court ruled that the insurance company should pay the claimant 160000 Dinars and the interest.
The insurance company appealed the ruling before the court of appeal. The court upheld the appealed ruling.
