Eviction – Demolition – Local Authority Permit – Dilapidated building – Evidence – Expert – Landlord – Tenant
This case involved an eviction order on the grounds that a property was dilapidated. The court had been wrong to ignore the defendant's request for an expert to review the building as there was no evidence in the demolition documents of the property's status.
Background
A landlord filed a case against a tenant before the court requesting the tenant to vacate a rented villa. The landlord said that the tenant had rented the villa but the villa became so old that he received a permit from the local council to demolish it. The landlord said that he requested the tenant to vacate the villa but they refused to do so.
The court dismissed the case.
The landlord appealed the ruling before the court of appeal. The court dismissed the appealed ruling and ruled that the tenant should vacate the villa.
