BCC 543/2007

This case involved the early termination of a tenancy agreement. The terms of the agreement which stated they should pay for the remaining period of the tenancy agreement unless they were leaving Bahrain were upheld.

Background

A landlord filed a case against a tenant before the court requesting the tenant to pay 1750 Dinars and interest. The landlord said that the tenant had rented a flat from him for one year and the tenancy agreement was renewed. The landlord said that Article 10 of the tenancy agreement stipulated that if the tenant wanted to terminate the tenancy agreement before the end of its period, he should pay the rent for the remaining period, unless the reason for terminating the agreement was their departure from Bahrain. The landlord said that the tenant had terminated the tenancy agreement before the end of its period and failed to pay the rent for the remaining period although he stayed in Bahrain.

The court dismissed the case.

The landlord appealed the ruling before the court of appeal. The court dismissed the appealed ruling and ruled that the tenant should pay the landlord 600 Dinars.
