Employee’s Rights – Unfair Dismissal – Transfer – Refusal – Salary
This case involved a claim by an employee for unfair dismissal. A key issue was whether the fact the employee had asked for a transfer then refused to take the transfer because the salary was lower had an impact.
Background
An employee made a complaint against a company before the Ministry of Labour claiming that they dismissed his from his job without justification. The Ministry referred the case to the court. The employee requested the company to pay him his entitlements and 4800 Dinars as compensation.
The court dismissed the case.
The employee appealed the ruling before the court of appeal. The court dismissed the appealed ruling and ruled that the company should pay the employee 1500 Dinars for compensation.
