Background

A company filed a case against a telecommunication company before the court claiming that the telecommunication company had announced a bid for providing a wireless communication service in Bahrain. The company said that the telecommunication company violated Bahrain Law No. 36/2002 because it had failed to provide the reasons of rejection of the bid made by the company though it was valid. The company requested the court to cease proceedings with the bid until the case was settled.

The court said that it had no mandate to consider the case and referred it to the administrative department in the civil court.

The telecommunication company appealed the ruling before the court of appeal. The court upheld the appealed ruling.
