This case involved a planning consent from building which was given by the local authority but they subsequently (after the building was built) refused to give the authorisation for electricity to be supplied because they decided that a retail property should not be allowed in that area. It was right that they had referred the matter to the urgent issues court.
Background
A claimant filed a case against a municipality before the court of urgent affairs claiming he had received a licence from the municipality in order to build a building on his land but it then refused to grant him a certificate in order to get the electric supply from the relevant entity and damaged to his project.
The municipality claimed that it had dismissed the license for opening commercial shops because the street where the building was located is unsuitable for commercial activities.
The court said that it had no mandate to consider the case.
The claimant appealed the ruling before the court of appeal. The court upheld the appealed ruling.
