Employee’s Rights – Transfer – Absence – Salary – Evidence – Termination of Employment
This case involved amounts due to an employee who had been transferred and was then dismissed after refusing the transfer. The new job had the same rights as the old one and the employee had been absent so dismissal was not unfair.
Background
An employee made a complaint against a company before the Ministry of Labour claiming that he was working in a company and the company transferred him to another position and that he refused the transfer and so the company dismissed him. The Ministry referred the case to the court. The employee requested the company to pay his entitlements and compensation.
The court ruled that the company should pay the employee 1818.225 Dinars for wages and 1080 Dinars for transportation allowance.
The employee appealed the ruling before the court of appeal. The court upheld the appealed ruling.
