This case involved a claim by a woman who had sold land to her husband via an informal contract which he had not paid for after he had sold it on. The key point was it was within the court's remit to decide if this was an informal contract even though the wife had not called for a hidden contract and the contracts were registered. The court also agreed that the initial amount awarded to the life had not taken into account all the evidence of what was owed.
Background
A woman filed a case before the High Court against her husband requesting and the Real Estate Registration Department and requested the court to order the husband to pay her 21650 Dinars with interest and cancel an informal sales contact because after she had sold him her two properties, the husband had sold them and refused to pay her. He had also seized her money and jewelry.
