BCC 479/2007

The original dispute involved a request for an urgent case ruling by a claimant who stated a bank had sold and profited from shares they owned without full authorisation. A key issue was whether the expert evidence was valid.

Background

A claimant filed a case against a bank before the court requesting the bank pay him 51670.9 Dinars and urgent case and expert fees. The claimant said that he invested in shares in four companies and wanted to sell his shares in three of them but the bank had refused this request and offered to buy the shares and then sold them at high prices. The claimant said that he had filed an urgent case against the bank and requested the court appoint an expert in order to determine the losses from selling the shares. The claimant said that the report of expert concluded at the time that the bank owed him the mentioned amount.

The court ruled that the bank should pay the claimant 51670.9 Dinars.

The bank appealed the ruling before the court of appeal. The court upheld the appealed ruling.
