BCC 431/2007

This case involved the eviction of a tenant for non-payment of rent. Although the tenant had paid part of the rent this did not mean the eviction decision should be dismissed.

Background

Some landlords filed a case against a tenant before the court requesting the tenant to vacate a rented property and pay 2700 Dinars and interest. The landlords said that the tenant had rented a villa from them for a monthly rent of 450 Dinars and he failed to pay the rent for the period from 15/05/2005 to 14/11/2005.

The court ruled that the tenant should pay the amount and that he should vacate the rented villa.

The tenant appealed the ruling before the court of appeal. The court upheld the appealed ruling.

Decision

The tenant appealed the ruling before the court of cassation and said in his grounds of appeal that the ruling had insufficient evidence of causation and that the court had ordered him to vacate the rented villa although he reached an agreement with the landlords after the issue of the appealed ruling to pay 700 Dinars and stay in the villa but the court dismissed this agreement.
