Landlord – Tenant – Tenancy Agreement – Notice – Extension – Eviction
This case involved a tenant who refused to leave a rented shop at the end of the tenancy agreement. The key issue was whether the landlord had given the correct notice that they did not wish to renew and what happened after that point if they had not.
Background
A landlord filed a case against a tenant before the court requesting the tenant vacate a rented shop. The landlord said that the tenant had rented the shop for a monthly rent of 90 Dinars and gave notice to the tenant that he would not renew the tenancy agreement but the tenant refused to leave.
The court dismissed the case.
The landlord appealed the ruling before the court of appeal. The court dismissed the appealed ruling and ruled that the tenant should vacate the rented shop.
