This case involved a request for the liquidation of a company by the individual who had set it up on the basis it had lost its capital. This was refused as there was no evidence it had lost its capital.

Background

A claimant filed a case against a defendant before the court claiming that he had set up a company with the defendant but the company did not work well and they lost their principal capital. The claimant said that the defendant, who was an American citizen, left Bahrain and requested the court to appoint a liquidator for the company.

The court dismissed the case.

The claimant appealed the ruling before the court of appeal. The court upheld the appealed ruling.
