This case involved a claim by an employee who had not been paid his salary and had had to resign for his dues. It was claimed there was no employment relationship between the parties as there was no contract but other evidentiary means including sponsorship details in the employee's contract could be used.
Background
An employee filed a case against an employer before the court claiming that he was working in a restaurant owned by the employer for a monthly wage of 150 Dinars and he left his job because the employer had failed to pay his wages. The employee requested the employer pay his entitlements and compensation in addition to a travel ticket.
The employer claimed that there was no working relationship with the employee.
The court dismissed the case.
The employee appealed the ruling before the court of appeal. The court upheld the appealed ruling.
